Terms of service
Scope of application and entry into force:
These General Terms and Conditions of Sale are applicable as of 20 November 2023.
Any contract entered into by Pilates Iberia, S.L. — hereinafter referred to as “Align-Pilates” or the “Company” — for the supply of goods and services shall be governed by these terms and conditions. The customer accepts and agrees to be bound by these General Conditions from this moment, declaring that they are aware of them and that they have been made available at the time of confirmation of the offer. Any agreement between the parties that differs from or is not included in this document shall require express acceptance in writing, specifying which conditions are rendered ineffective.
Acceptance:
This offer must be accepted in writing by the customer or their legal representative, in full. Such acceptance constitutes a firm and irrevocable purchase offer by the customer.
Prices:
The offer shall apply the list price in force at the time. Prices do not include transport or installation. Transport costs vary depending on dimensions, weight and destination. Additional costs such as customs duties or handling outside ground level shall be borne by the customer. Discounts are not cumulative; the most favourable discount applicable at the time of purchase will be applied. The Company may modify prices in the event of changes in costs or delays beyond its responsibility.
Payment terms and method:
The agreed payment term and method are essential elements of the contract. For payments through financing, leasing or renting, approval by the corresponding financial institution is required.
All contractual documentation must be sent to Pilates Iberia, S.L. together with the signed delivery note upon receipt of the goods. In the event of non-payment, late payment interest and recovery costs shall apply.
Accumulation of discounts:
Discounts and promotions are not cumulative unless expressly stated otherwise. The most beneficial discount shall be applied.
Order modification or cancellation:
Requests to modify or cancel an order may be made up to 20 working days prior to the scheduled delivery date, except in the case of customised products. The Company reserves the right to accept or reject such requests.
If no written response is received within 10 days, the request shall be deemed rejected. Late cancellations may incur a surcharge of 20% of the order value.
Delivery of products:
The customer will be notified by email of the dispatch date and the carrier’s details. The Company shall not be responsible for damage occurring after delivery. The customer must check the condition of the goods upon receipt and record any observations on the delivery note.
Claims for damage must be submitted within 24 hours to postventa@thomas.es.
Delivery methods:
Standard delivery is “door-to-door”. Unpacking, internal transport and assembly are not included unless contracted separately.
The customer may use their own transport method if they so wish.
Delivery options for Spain and Portugal:
Standard delivery with delivery inside the building:
Standard deliveries are made at street level. Deliveries inside the building require prior coordination and may involve additional costs.
Delivery with installation:
This includes transport, unpacking, assembly and removal of packaging. It is an additional service that requires photographs of the installation site. The customer must provide information regarding access and confirm the date and time at least 72 hours in advance.
Available only in Spain and Portugal. For international orders, transport will cover delivery to the indicated address, provided it has been contracted.
Right of withdrawal and returns:
Exercise of the right:
The customer may withdraw within 14 calendar days, except for customised products. Notification must be made in writing to the Company’s address or by email to postventa@thomas.es.
The withdrawal form set out in Annex I may also be used.
Consequences of withdrawal:
Payments received will be refunded, excluding additional costs. Products must be returned in perfect condition, in their original packaging and with all documentation, within a maximum of 14 days.
The refund will be made using the same payment method. The Company may withhold the refund until the products have been inspected.
If the order has not been dispatched, it may be cancelled at no cost.
Returns of defective products:
This must be reported immediately to postventa@thomas.es with details and photographs. A courier will be arranged to collect the product. The product will be assessed and confirmation of replacement or refund will be provided by email within a maximum of 14 days.
If the product is confirmed to be defective, a full refund will be issued using the same payment method.
Transfer of ownership:
Ownership of the products is transferred only once full payment has been made. The customer is responsible for the condition of the product from the moment of delivery.
